Designs can be protected both in Denmark and internationally by design registrations - or in some jurisdictions by Design Patents.
The design protection applies to the visual embodiment of a product or parts thereof. With a design registration it is possible to obtain exclusive rights to the aesthetic design of a product - or part of a product - for up to 25 years.
It is a requirement that the protected part of the product is new at the time of application and is distinctive from previous designs. However, a designer has - in many countries - up to 12 months from the initial publication of the design to file an application for registration.
